Match homeowners with independent third-party contractors, home improvement providers, credit repair services, and financing partners

May conduct soft credit checks through our credit verification partners

Send marketing information and facilitate introduction to partners

We are NOT a contractor, lender, credit repair company, government agency, or utility provider.

We do not perform installations, repairs, credit services, financing, or rebate approvals.

2. CONSENT TO CONTACT & MARKETING COMMUNICATIONS (TCPA REQUIRED)

By submitting your information on our Site or through any form, you:

Expressly authorize Texas Energy Rebates and our partners to contact you

Consent to being contacted via phone, SMS/text messages, and emails

Understand that contact may be made using autodialer systems, prerecorded messages, or automated technologies

Acknowledge that message/data rates may apply

3. SOFT CREDIT CHECK AUTHORIZATION

Grasp International, iSoftPull, or similar partners

to perform a soft credit inquiry for the purpose of:

Determining eligibility for financing

Verifying program or incentive eligibility

Matching you with appropriate service providers

Soft inquiries do NOT affect your credit score.

Co-Owners of Property

If you provide information related to a co-owner of the property, you represent and warrant that:

You have authority to provide such information

Each co-owner has provided consent for a soft credit check

You authorize our partners to evaluate all listed property owners for eligibility

4. NO GUARANTEES OF REBATES, SAVINGS, APPROVALS, OR OUTCOMES

You acknowledge and agree that:

We make no guarantees regarding rebates, incentives, program eligibility, financing approvals, installation availability, or energy savings

All savings figures (e.g., “up to 60%”) are estimates only

Rebates and incentives may change at any time due to program rules, contractor availability, utility decisions, or government changes

Meaning of “No Extra Cost” or Similar Language

Statements such as:

“No Extra Cost”

“No Additional Out-of-Pocket”

“Same Price As Your Current Bill”

mean only that potential energy or utility savings may offset some or all costs.

These phrases do NOT mean upgrades are free.

5. NO RESPONSIBILITY FOR CONTRACTORS OR PARTNERS

Texas Energy Rebates:

Does not provide contracting, installation, repair, credit repair, or lending services

Does not supervise, warrant, or guarantee any partner’s work, pricing, performance, approvals, or claims

Is not liable for any contractor actions, omissions, delays, damages, or representations

Any arrangement between you and a third-party contractor or lender is solely between you and them.

You agree that Texas Energy Rebates is not responsible for:

Workmanship or service quality

Property damage

Contract terms

Pricing, interest rates, or loan terms

Missed rebates or denied applications

Miscommunication between you and partners

6. USER REPRESENTATIONS

By using our Site, you represent and warrant that:

You are at least 18 years old

You provide true, accurate, and complete information

You have authority to provide information about co-owners

You will not use the Site for unlawful purposes

You will not submit fraudulent or misleading information

7. PROHIBITED USES

You agree not to:

Submit false or misleading information

Use bots, scripts, or automated data collection tools

Harvest emails or scrape data from the Site

Attempt to interfere with Site functionality

Upload malware, harmful code, or spam

Misrepresent identity or property ownership

We are NOT liable for any indirect, incidental, special, consequential, punitive, or exemplary damages

We are NOT liable for contractor work, financing decisions, or missed savings/rebates

Our total liability for any claim is limited to the lesser of:

(a) the amount you paid us (if any), OR (b) $100 USD

This limitation applies to all claims, whether based in contract, tort, negligence, strict liability, or otherwise.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Texas Energy Rebates from any claim arising out of:

Your use of the Site

Your interactions with partners

Your breach of these Terms

Your misrepresentation of information

12. ELECTRONIC COMMUNICATIONS & SIGNATURES

By using the Site, you consent to electronic communication and agree that:

13. GOVERNING LAW

These Terms are governed by the laws of the State of Texas.
